The problem
Bell Lax’s client took out home and contents insurance. He suffered from a burst water pipe and his house was flooded. His insurers refused to pay out.
Our client’s insurers said that our client had not complied with the terms of his policy and was not living at the house. Despite authorising their employees to strip the client’s house and dispose of all of his possessions, they refused to compensate him for any of his losses. The insurer then said that the client had caused the flood himself.
The solution
We offered the client a ‘no win, no fee’ agreement to bring a claim against his insurers. Following a painstaking exercise collecting evidence showing that the client had complied with the policy and that the flood was caused by a frozen pipe due to record cold conditions, the insurers threatened to go to court and hoped that our client would give up rather than face the risk of losing.
We convinced the insurers to attend a mediation. During the mediation, we persuaded the insurers of the strength of our client’s case and they agreed to pay for his losses and his legal costs.
