The new Online Civil Claims Service was launched in March 2018 and allows individuals and businesses to bring legal claims up to £10,000 in value, resolve disputes out of court and access mediation. The service can be used by anyone across England and Wales for most low value contractual or consumer problems, such as claims that goods or services were not provided as promised.
Not only does this new online system save on paper, it also saves time and money as it encourages people to settle their disputes online rather than in court. Claims can be commenced far more easily than the traditional system of filling in and posting a paper form to the court or even using the existing online system.
There is a fee to use the service which varies depending on the value of the claim. The lowest fee for claims up to £300 is £25 and for claims up to £10,000 the fee is £410.
If you receive an email stating a money claim has been made against you and you are unsure whether it’s genuine, as fraudulent emails demanding money are on the rise, you can contact the Courts and Tribunals Service to check it’s valid.
If you have been served with an online claim, you will have the choice whether to respond to the claim online, or on paper. Failure to respond to the claim will allow the claimant to request a judgment in default which could impact on your credit rating.
In the future, the service will expand, increasing the maximum value of claims above £10,000.
