Litigation solicitors negligence - failed to present the right case

A businessman instructed solicitors to recover money he had loaned to fund the purchase of a property. The claim was complicated and the solicitors briefed a barrister to help with the court proceedings. Both the solicitors and the barrister underestimated the complexity of the type of claim and the court would not allow the businessman to recover his loan. When the businessman refused to pay the solicitors for the work they had got wrong, they sued him. Acting under a ‘no win, no fee’ agreement with after the event insurance, Bell Lax recovered the value of the loan from the solicitors and the barrister and successfully defended the claim against the businessman.
